In its recent reevaluation of the compliance policy for deemed tobacco products that were on the market on August 8, 2016, FDA has focused primarily on flavors and convenience stores. Is this the right focus? Are flavors the main appeal of e-cigarettes to youth? Are convenience stores the primary source for youth purchases? How would FDA’s proposed changes to the compliance policy impact adult smokers? Are there other regulatory approaches that might strike a more appropriate balance?
